Definition

raffaella loï design is a registered trademark based in Paris, France. raffaella loï design offers design works (also called in this document: "creations") published by its suppliers in unique pieces, in numbered editions, or in limited series which can be acquired by direct order, or by email at contact@raffaella -loi-design.com, online on its website www.raffaella-loi.com.

Application and acceptance of the general conditions

These general conditions apply to all sales of creations made by raffaella loï design on its website www.raffaella-loi.com. In addition, these conditions apply to any sale made by direct exchange or by email, between the Customer and raffaella loï design. By placing an order, the Customer acknowledges having read these general conditions and acknowledges accepting them.

Realization

Design works, also called creations, are original works designed by raffaella loï design. The creations sold on www.raffaella-loi.com are manufactured by Société Décomarbre, a simplified joint-stock company with a capital of €200,000, whose head office is located at 94 avenue de Rigny, 94360 Bry-sur-Marne, registered Registered at RCS on 21-12-1984, intra-community VAT number FR13331271361, RCS Créteil B number 331 271 361.

Characteristics of the creations

The creations referenced by raffaella loï design are design pieces, available in unique pieces, in numbered editions, or in limited series and are considered as unique and original creations designed by Raffaella Loï, exclusive designer.

Due to the manufacturing process, based on the recycling of materials, and the choice of materials used, the finish may vary slightly from one piece to another depending on the nature of the materials and exchanges cannot be accepted on this sole reason. .

In addition, the creations are presented on the website www. raffaella-loi.com by photographs and images whose perception on the screen may be slightly different from the actual piece. The differences that may exist between an image and the real characteristics of the creations cannot be considered as defects and no disputes or refusal of the order for these reasons can be accepted.

ONLINE ORDERS

The Customer has the possibility of directly ordering one or more creations on the site www. raffaella-loi.com and create a personal account.

Opening a personal account

The registration of the Customer entails the opening of an account in his name, which he can access at any time using his username and password and which allows him to manage the use of the account and the follow-up of the orders that he he performed on the site.

When opening his account, the Customer must fill in the required information: choose a username, a password and tick the acceptance of these general conditions of sale. The Customer guarantees that the information provided in the registration form is accurate.

raffaella loï design undertakes to keep the Customer's data secure in accordance with the regulations in force. If the Customer's data were to disappear, following a fortuitous event, a breakdown or a case of force majeure, the responsibility of raffaella loï design cannot be engaged, which the Customer acknowledges and accepts.

Online ordering

To place an order, the Customer selects one or more creations, in one or more copies, and adds it to his basket. Each order includes the description of the part, the selling price excluding taxes (HT) and all taxes included (TTC) in Euros (€).

When ordering, the Customer has the possibility of choosing the withdrawal by his own means from our approved manufacturer Décomarbre, or of making a delivery by parcel, see in the conditions of the article “Withdrawal and Delivery”. If he chooses delivery by parcel, the Customer provides his delivery address and any delivery instructions.

To finalize the order, the Customer must validate his billing details, then make the payment, in accordance with the provisions of the “Price and Payment” article. An order confirmation email is sent automatically.

Failing to receive the actual payment from the Customer within 5 working days from the date of the order, the sale will be cancelled.

Online order confirmation

Within 3 working days after receipt of payment and confirmation of the availability of the creation ordered, the Customer receives an order confirmation email from raffaella loï design.

In the event that a piece is no longer temporarily available at the time of the order, raffaella loï design will inform the Customer of the new availability deadlines induced by the manufacture of the creation. The Customer will have the option of canceling the order within five days of receipt of the email informing him of the new deadlines, by accessing his personal account and/or tracking his orders on the site.

In the event that a piece is definitely no longer available at the time of the order, raffaella loï design will confirm by email to the Customer the immediate cancellation of the order and the non-remittance of payment to the bank.

Provision of the Room

raffaella loï design will inform the Customer by email as soon as the creation is available for collection from the collection address of its manufacturer, Décomarbre, or for delivery of parcels to the Customer's address under the conditions provided for in the article "Collection and Delivery”.

PRICE AND PAYMENT

The prices

The prices mentioned are in Euros (€) and excluding taxes (HT). The prices do not include the delivery costs which vary according to the weight of the creation, see the article "Collection and Delivery". The full price of the creation, excluding delivery costs, is payable upon validation of the order.

For parts shipped to a country of the European Union, French VAT at the rate in force applies to the summary of the order. For parts shipped outside the European Union, only the price excluding taxes will appear on the order summary. Any customs duties, local taxes, import duties or state taxes are the responsibility of the Customer, both in terms of declaration and payment to the competent authorities and bodies of the country.

Some creations, and in particular limited edition pieces whose price may vary according to the number of the piece in the series, are displayed without indication of price or within an indicative price range. Prices may be subject to revision by raffaella loï design at any time at its sole discretion.

Secure payment

Payments for creations and delivery costs are made online by credit card. raffaella loï design uses the Stripe e-commerce payment platform that meets distance selling security standards: PCI DSS level 1 certification, SSAE18/SOC 1 type 1 and 2 and SSAE18/SOC 2 type 1 and 2 reports, Complies with the European Directive DSP2 and Strong Customer Authentication, Money Transfer Authorizations in the USA, Electronic Money Establishment Licenses in the EU and the UK.

Payment by credit card is made using 3DSecure secure transactions, Visa and MasterCard protocol, all card numbers are encrypted on disk with AES-256. Decryption keys are saved on separate devices. Stripe's infrastructure for storing, decrypting, and transmitting card numbers operates independently, without sharing any sensitive information with Stripe's core services.

raffaella loï design has no access to the Customer's confidential information relating to the means of payment.

The Customer guarantees that he has the necessary authorizations to use the payment method chosen. raffaella loï design reserves the right to suspend or cancel any order and/or delivery, in the event of non-payment of any sum due by the Customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Service.

Late penalties

In order to meet the requirements of Articles L441-3 and L441-6 of the Commercial Code, any delay in payment will automatically give rise and without any formal notice being necessary, to the payment of a penalty payable on the day following the date of payment mentioned on the invoice, at a rate equal to three times the legal interest rate, as well as the payment (for Professional Customers) of a lump sum indemnity for recovery costs of a minimum amount of 40€.

RETENTION OF OWNERSHIP

Sale of design work

The piece sold remains the property of raffaella loï design until full payment of the price, including delivery costs where applicable.

Ownership of the work

Within the framework of the order or the purchase of a work, the Customer acquires only the “material medium”. The incorporeal property rights that are the economic rights and the moral rights belong to the author of the work: here the designer Raffaella Loï (cf. articles L121-1 to L122-12 of the Intellectual Property Code).

The designer's moral rights are “perpetual, inalienable and imprescriptible”. It is linked to the person of the author, who cannot renounce it or transfer it to others. Upon his death, this right persists for the benefit of his heirs during the current calendar year and the following 70 years (cf. article L123-1 of the Intellectual Property Code).

COLLECTION & DELIVERY

The Customer has the option of choosing between withdrawing the order by his own means, or having the ordered creation delivered to the place of his choice.

In the event of withdrawal from the Décomarbre manufacturer, the Customer has, unless otherwise agreed, a maximum period of 15 days to withdraw his order. Beyond this period, raffaella loï design reserves the right to invoice the customer for storage costs.

When ordering, it is the Customer's responsibility to ensure the dimensions of the creation in relation to its destination space. Upon delivery of the creation, the Customer agrees to be present or to appoint a responsible person, capable of ensuring the proper receipt of the order. The Customer is required to check that all his personal details are up to date. In the event of an error in the delivery details or lack of access, the Customer will be solely responsible and he will have to pay the costs again to arrange a new delivery.

RETURN AND EXCHANGE

In the event of withdrawal, the Customer or the Customer's carrier must ensure the proper conformity of the creation and the absence of defects. Once the withdrawal has been made, any request will be deemed inadmissible.
In case of delivery ensured by raffaella loï design, any complaint on the goods must be addressed within 48 hours after receipt (with photos and copy of the voucher with reservations) by sending an email to the address contact@raffaella-loi-design .com. After this period, any declaration will be inadmissible. If the dispute gives rise to reimbursement, raffaella loï design will pay the Customer the sale price, and any delivery and return costs.

Cancellation and right of withdrawal

Unique creations made to order cannot be canceled or returned. After validation of an order, no refund can be accepted and full payment for the unique creation will be required.

For creations in stock, the Customer has the option of returning the item to the sender within 14 days of receipt of his order. The Customer exercises his right of withdrawal directly from raffaella loï design by sending an email to contact@raffaella-loi-design.com.

raffaella loï design will reimburse the Customer for his order, delivery costs included. The return costs remain the responsibility of the Customer. The creation must be returned in perfect condition, in its original packaging and shipped under the same conditions as it was sent.

The right of withdrawal does not apply in the following cases: if the creation is made to order or made to measure; or if the Customer is not a national of one of the member countries of the European Union as well as Iceland, Norway and Liechtenstein in accordance with the regulations in force.

PERSONAL DATA

For the needs of the online ordering service with the opening of a personal account, the processing of the raffaella loï design order collects the Customer's personal data which is processed by computer. The data that may be collected are used or communicated by raffaella loï design only for the purposes of order management. The right of access, rectification, deletion and opposition for legitimate reasons, of this nominative and personal data, as provided for by Law No. 78-17 of January 6, 1978 amended on Computing, files and freedoms, can be exercised by the Customer by email to contact@raffaella-loi-design.com.

APPLICABLE LAW – COURTS

These general conditions are subject to the application of French law. For disputes relating to the interpretation or execution of these general conditions, the French courts will have sole jurisdiction.
